Age Discrimination in Employment Act (ADEA)

Age discrimination occurs when an applicant or employee is treated less favorably due to age. The ADEA:

  • Applies to employers with 20 or more employees
  • Prohibits discrimination against individuals age 40 and older
  • Requires that employers provide equal access to group health plan coverage for older workers

Civil Rights Act/Pregnancy Discrimination Act (PDA)

Pregnancy discrimination occurs when a woman is treated less favorably due to pregnancy, childbirth, or related medical conditions. The PDA:

  • Applies to employers with 15 or more employees
  • Prohibits employers from discriminating in any employment practices based on pregnancy-related conditions
