12.4 Policy Renewal Provisions

Each health insurance policy must clearly state the conditions and provisions governing the continuation of coverage. The policy must specify both the effective date and the termination date. Insurers may cancel or decline renewal in accordance with the applicable renewal provision, particularly if required premium payments are not maintained.

Noncancellable – This provision guarantees that the policy will remain in force until a specified age (commonly age 65), as long as premiums are paid. Premium rates are fixed and cannot be increased, and policy benefits or terms cannot be altered by the insurer. Only the policyowner has the right to cancel the policy, making this the most favorable option for the insured.

Guaranteed Renewable – This provision allows the insured to renew the policy at their option—typically until age 65 or for life—without providing evidence of insurability. While coverage cannot be canceled by the insurer, premiums are not guaranteed and may be adjusted on a class basis, but not for an individual insured.

Conditionally Renewable – This provision states that the policy may be renewed as long as specified conditions are met. The insurer retains the right to terminate or refuse renewal by providing notice, or under certain conditions that must be clearly outlined in the policy at the time of issuance.

Optionally Renewable – This provision states that renewal of the policy is at the discretion of the insurer. The insurer may choose whether to renew coverage on the renewal or policy anniversary date.

Cancellable – This provision allows either the insurer or the insured to terminate the policy at any time. Because of the flexibility it provides to the insurer, this type of policy typically carries lower premiums but offers the least level of security for the insured.

Period of Time (Nonrenewable) – This provision indicates that the policy is issued for a fixed, specified term. Coverage ends at the conclusion of that period and cannot be renewed or extended beyond the stated expiration date.

If covered medical services are rendered while the policy is in force—even if they occur immediately prior to termination—the insurer is obligated to process and pay the claim in the same manner as any other covered claim.
